The ninth circuit court has maintained a prohibition on sending national guard in Portland, Oregon, following a recent legal decision.

Judicial Panel Agrees to Reconsider Legal Matter

The federal appeals court decided on Tuesday that it would rehear the case concerning the president’s authority with an larger panel of eleven justices. The judicial body also vacated a earlier decision from a three-judge panel that had sided with the federal government.

Legal Saga Over Troop Deployment

This order represents the latest development in a protracted legal battle over whether the administration has the legal right and justification to deploy national guard forces in the city. Approximately two hundred troops have been in limbo since the end of September when the mobilization attempt was started in response to months of protests.

Differing Viewpoints

The federal government has argued that federal officials at the immigration center in the southern part of the city were under attack, while local authorities assert that local officers have command of the circumstances.

Contrary to characterizations of the city as a conflict zone, locals have been posting videos of lush hiking trails and a vibrant culinary culture, and organizing events such as an protest bicycle event against the “militarization of our city”.

Court Proceedings

The appeals court decision came after a federal judge in Portland enacted two temporary restraining orders this month – one preventing the federalization of the Oregon national guard, and another stopping the deployment of any national guard troops in the state, after attempts to circumvent the initial injunction by calling up troops from California.

On Monday, the appeals court had put the first ruling on hold – permitting control of state troops – but the subsequent injunction remained in place, blocking the actual deployment of the forces.

The latest ruling means the matter will be heard by the full court – with both rulings under consideration together – by a group of eleven justices.

“This decision shows that the truth matters and that the judicial system are working to hold this administration accountable. The constitution limits the president’s power, and Oregon’s communities cannot be treated as a testing site for unchecked federal authority,” said the state attorney general in a statement.

“The court is sending a clear message: the executive leader cannot send the military into American urban areas unnecessarily. We will continue defending Oregon’s laws, values, and sovereignty as this case progresses and our fight continues in the judicial system.”
